My last hire, was a failed hire. He was so paranoid that I was secretly recording, he examined my room - thought the LED power indicator on my TV was a camera, moved other equipment, and refused to remove his sunglasses or baseball cap for the session.

 

I understand the concern, to some extent, but it was still irritating. I lost all interest in "playtime" and kicked him out of my home.

I would think that secretly photographing someone for other than personal consumption without the other person's agreement (other than going to the police - which means you would be admitting to conspiracy to commit an illegal act without police instigation) would have some legal components to it.

Yes, using this footage would most likely be illegal.

The concern is blackmail, for example for for those of us who are married, or have an employer that would not support our hobby as a valid after-work activity, or those of us that hold a position in public office. Some owners of such cameras might think “he will not dare to report my blackmail to the police, because that would put them in a worse situation than just paying up. “

I guess if the guy is an escort all you would have to say is, "Go ahead, give it to the police. And they are going to investigate you and find out that I certainly was not the only person who you were selling your wares to. And each of those violations would be chargeable." If you plan on using it by showing my wife\partner, I would immediately go to the police and have you charged with a crime of blackmail and filming someone without their permission. Perhaps my boyfriend would throw me out of the house, maybe he won't. I might be charged with having sex with an escort (one time and if they could prove that). Which person would you rather be?" It is something we have to rehearse so have the presence of mind to say to the despicable person who would do such a thing.

In many states, secret recording is allowed as long as just one of the parties involved knows it (presumably the person doing the recording!!;))

You sure that applies to video?

 

If wiretapping laws don't apply, it's likely not illegal as long as it's not sold/used for profit and usage doesn't run afoul of anti-revenge porn laws enacted by a handful of states.

 

I mean, upskirt photography isn't illegal in most places. There was a case in Massachusetts that was dismissed for this reason; I believe the legislature fixed that.
